Terms of Service

These Terms of Service ("Terms") govern access to and use of Tipsy Tapper websites and services. By using the service, you agree to these Terms. If you use Tipsy Tapper for a business, you represent that you have authority to bind that business.
1. What Tipsy Tapper provides
Tipsy Tapper provides web-based tools that let guests send order and service requests associated with a specific venue location, and that let authorized venue personnel receive and manage those requests. Tipsy Tapper is a communication and workflow service. Unless expressly added in a future release, it does not process guest payment or replace a venue's point-of-sale system.
2. Venue responsibility
The venue—not Tipsy Tapper—is responsible for its menu, prices, taxes, product availability, staff decisions, fulfillment, customer service, regulatory obligations, and the sale or service of food and beverages. Sending a request does not guarantee acceptance, availability, timing, or fulfillment.
3. Alcohol and age-restricted products
Alcohol service remains subject to applicable law, valid identification, staff approval, responsible-service practices, and venue policy. Tipsy Tapper does not verify age and does not guarantee alcohol service.
You may not use the service to evade age verification, staff discretion, venue rules, or applicable law.
4. Guest use
You agree to submit accurate requests from the service point you are actually using and to avoid duplicate, fraudulent, abusive, or disruptive requests. You may not photograph, share, or reuse a service-point link to submit remote or unauthorized requests. A venue or Tipsy Tapper may limit, decline, cancel, or block requests to protect guests, staff, and the service.
5. Accounts and access
You are responsible for keeping account credentials confidential and for activity under your account. Venue administrators are responsible for assigning appropriate staff access, removing access when it is no longer needed, and maintaining accurate venue information. Contact us promptly if you suspect unauthorized access.
6. Text messaging terms
Tipsy Tapper may offer optional transactional text programs for order updates and account security. By separately providing your mobile number and opting in at the relevant prompt, you consent to receive messages for the specific purpose described there.
- Program: Tipsy Tapper transactional order notifications and account verification.
- Frequency: Message frequency varies; typically one to four messages per order or verification event.
- Charges: Message and data rates may apply.
- Opt out: Reply STOP to stop applicable messages.
- Help: Reply HELP or email support@tipsytapper.com.
- Delivery: Carriers are not liable for delayed or undelivered messages.
Consent to text messaging is not a condition of using guest ordering or purchasing any product or service. See our Privacy Policy for how we handle mobile information and consent.
7. Acceptable use
You may not misuse the service, interfere with its operation, attempt unauthorized access, probe security, scrape or copy protected content, transmit malware, impersonate another person, violate law, infringe rights, or use the service to harass venue staff or guests.
8. Intellectual property
Tipsy Tapper and its software, design, branding, and content are owned by Tipsy Tapper or its licensors. Venues retain rights in the venue content they provide and grant us permission to host and use that content to operate the service.
9. Availability and changes
We work to keep the service available but do not guarantee uninterrupted or error-free operation. Features may change as the product develops. We may suspend access for maintenance, security, abuse prevention, legal compliance, or violation of these Terms.
10. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
11. Limitation of liability
To the maximum extent permitted by law, Tipsy Tapper will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, missed requests, or venue fulfillment decisions arising from use of the service. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Termination
You may stop using the service at any time. We may suspend or terminate access where reasonably necessary for security, misuse, nonpayment under a venue agreement, legal compliance, or material violation of these Terms.
13. Changes to these Terms
We may update these Terms as the service changes. The revised Terms will be posted here with an updated effective date. Continued use after an update means you accept the revised Terms where permitted by law.
